about a week ago'ish, I bought a Xonar D2x from a shop that I use to shop at until they went under & were sold off/bought out by somebody else. before this - the shop was very reputable & Since i was there a lot. I knew the manager by his first name & managed to get some knock down deals from the guy....

anyhoo - so the store now is under new management & they have gotten rid of all the old staff. having never bought anything from the shop since it enterd new management I decided to give them ago despite how much my senses were telling me not to....

So i purchased a Xonar D2X from them & from the moment I plugged it in till the moment I pulled it out I had nothing but headache after headache. but the final straw was when it started tripping the power in the middle of bootup, then it stopped playing audio through the rear channels all together & I had to crank my logitech Z5500's almost up to 70% to get a whisper out of the card....

I packed it back in the box & took it back to the store where the assistant didnt seem to happy to see me after I announced that I was having major problems & would like a refund.

He started throwing up excuses. stuff like saying my PSU wasnt powerful enough. he even went as far as blaming windows 7 & also explaining that I had to set some jumpers on my motherboard to get the card to function perfectly.....after much words about how 'I' supposedly wasnt setting it up correctly excuse that fact that Ive been doing this in my sleep since 2001. he agreed to take the card in for testing - but it would take 2 days & if the card was faulty he would charge ME P&P to send it back to the manufacturer.

I told him that by law he couldnt charge me for something like that & that any faulty items bought from the manufacturer should be sorted out between the shop & the manufacturer themselves since the reciept is like a contract.

Despite what I said. he still refused to give me a refund. & told him it was against the law to keep my money if I wasnt satisfied with the product. & since I bought it back while it was still under shop warranty I expected nothing less then to have my money back no fucking drama like this guy who was in the midst of shitting his pants while trying to stick it to the man (which is me)

I warned him that refusal to refund my money would mean that I would be making a complaint to the Trading Standards & that they are liable to go to court If they still refuse to refund my money. so the guy said go ahead & I laughed & told him not to worry, that will be the first thing i do when i get a free moment, I asked the assistants full name so that I at least have a contact name to give the trade officials but he wouldnt give it to me LOL. He then told me that the manager was on his way in & that he would be about 3 hours.

I laughed & looked at him & asked him if the manager was coming into work (central london) from Paris or something. because I am not waiting 3 hours just to be fucked around by an even bigger knobhead. but they way this assistant was going on about it, it was like the manager was just 5mins around the corner.

After multiple failed attempts to get in touch with the manager - I no longer have time to waste playing with clowns so I called up the Trading Standards & chatted to a guy who advised me to write a letter to them telling them that they had breached the Sale Of Goods act, the trading standards have been notified & are aware of the situation & that they have 14 days to respond to the letter otherwise further action will be taken.


well....I think ive got a fat wad of compensation cash lined up. I dont think the idiots at the shop will take my letter seriously for a second.

If the case escualtes & they do get called into court I will be asking them to refund my £90 for the faulty Xonar D2x, £143 for the Xonar STX I had to purchase in place of the faulty D2X & a further £400-500 for wasting my time & maybe another £300 for hurt feelings. since they accused me of building my machine wrong.

Yeah kick their ass. Usually when I go into a pc shop like that I know more than the people who are fixing it. I hope you end up with enough for a 5970 :laugh:

haha, I will push hard for compensation - I'l even call a newspaper & try get them involved so i get more compensation to the point where Im literally blackmailing the shop manager.

but managers like that shouldnt be running a shop at all. its the most hands off approach ever. Its a different story if you have confidence in your staff - but unfortunately the staff are all a bunch of pillocks

The manager should be there managing. I'd rather be there and in 100% control of the shop if I was him. Take for example your situation could easily have been resolved if he was there. Then again he might take the side of the assistant and be a total ballbag.

as much as I agree - their not really a well stocked brand on the high street & I dont want to ask my dad to 'borrow' the use of his credit card to buy stuff online unless I need at least 5 items.

My dad is really anal about buying shit online - hes afraid someone might capture/steal his details & empty his account. (poop)(poop)

so yeah, & since a lot of hardware stores have closed due to the recession - there is very little choice left where i can buy stuff in confidence without having to worry about stuff working when i buy it from certain shops.

there are some shops that sell & stock a wide range of gear that Ive never had a problem with....but - they're overpriced big time & usually tend not to budge very far when it comes to bartering for prices... & frankly their not on my favorite list of shops.

small update on the situation --

theyve totally ignored the letter I sent them about breaching the Sale Of Goods act & that the trading officials were awear of the situation... give them 2 weeks to respond - they did fuck all :D they didnt even bother ringing me.

& I have been advised to send them a final warning before legal action is taken.

I knew them idiots wouldnt bother replying anyway.

But they are right. You need to set some jumpers on the mobo. Also, you have to apply a thin layer of mustard to the CD-Drive. Then, and ONLY then it will work.

thats exactly what the shop assistant was telling me. & I asked him....how come Asus support doesnt say so & all the guys on Asus forum?

but yeah - 2moro I will start this shit rolling. I want my money back

That reminds me of the "network specialist" I had at my apartement once. I couldn't get a working connection, so I gave in and called an "expert". Well he knew LESS about networks than I did, and I do not know very much about them.

I'm just glad the shop where I'm a local has employees who know their stuff. I hope this stays like that.

I had some guy from virgin tell me my pc was too slow for the broadband hence why I was getting packet loss.

Yeah for DSL6000 you need minimum a 600W PSU. Oh and for Gods sake keep your network cable as straight as possible, i.e. prevent turns. Because the packages can in fact fly out of the cable due to centrifugal power. You know when they come to a 90° turn with too much speed?

also I think that faulty D2X was the one that started the countdown to the death of my then current PSU & 1 of my 2 graphics cards. that D2x was just tripping the power like mad & I think all the feedback damaged the PSU somewhat which started to deteriorate until it could no longer regulate the voltage & spiked. killing 1 of my 2 4870's which has been on RMA over 2 weeks now...

Im starting to get jittery - the longer they make me wait, the more I think they cant find another 4870 to send back & send me a 5770 which will fuck up my supposed crossfire setup... oh well...I can still pwn the 4870 toxic off for a good price then buy a 5770 since it performs better then the 4870 at higher resolutions :o

I once was talking to a ISP guy at our other store as I called them for our horrible internet service, and I told him. "Just run ping with the time to live command and watchthe connectin jump around."

There was silence for about 10 seconds, and uhhh, what is the uhh, command to uhh, run ping again?

After I told him how to even open the cmd window, he still condn't figure it out, and then I finally got him through that and asked if he knew what any of it meant. Nope, it meant fuck all to him.

He was the guy accusing my Sonicwall of being bad, or old. Cause he never saw one before evar.

well...I would like £400-500 compensation but after chatting to my dad about it (he has more experience taking people to court then me) Its unlikely that i will get compensation. I'l probably just get a refund & expenses back for all the letters, phonecalls & trips into the shop to see the manager I made. so I'm probably looking at around £120. since the court isnt one of them big major ones that takes on criminal cases. (small claims court) but I will see anyway, I'l go get some legal advice from some solicitors & see what I can do. since my dad said you cant ask for compensation for 'time wasted'. but £400 would be pretty sweet.... instant 4970......*dribbles*

Good luck with the case, I like it when people take a stand against companies. It wouldn't surprise me if my ISP was doing something illegal.
