OMFG I'm so disappointed.

I bought this item (http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=110461402797&ssPageName=STRK:MEWAX:IT), it was THE perfect present for my daughter.

http://img.techpowerup.org/091211/Untitled.jpg

Seller (http://myworld.ebay.co.uk/nicholas3754/) has 154 all 100% positive feedback.

He shipped only to UK in the listing, so I asked him how much it'd cost to ship item to Malta and he told me it would be 8 sterling.

Then it happened that I had to take my daughter to hospital. In-between hospital days (http://www.generalnonsense.net/showthread.php?t=1680), I logged in to check, found item and saw it said 15 sterling for shipping. So I informed seller that I had to make the purchase now (told him about it being xmas present for daughter in hospital and all) to get it arrive on time but to please correct shipping to say 8 sterling instead of 15.

He told me not to worry and that he'd refund me the difference.

In my hurry I bought, paid and gave him my paypal to get the 7 sterling back.

Nothing came back though...

After me and my daughter were back at home from hospital I reminded him once, twice and 3 times.... no reply.

He had already given me positive feedback.

Today I received item... being very obviously damaged, and very obviously not in transit but was damaged from the start and NOT described in the listing!!

I'll just quote what I pm'd him through ebay:

Dear nicholas3754,

I'm sorry sir but at this point I have no choice except lodging a complaint both with ebay and paypal and leave you negative feedback illustrating my complaint in detail.
In the first place you promised me 8 STG shipping, I was charged 15 STG, you promised a refund yet this never materialised even after reminding you repeatedly.

SECONDLY, AND MORE IMPORTANTLY THAN THE ABOVE, THE received item NOT AS DESCRIBED. NOWHERE in listing is it stated that keyboard wire is TORN IN HALF, like someone cut it with scissors!! You described your item 110461402797 as new w/out box not as DAMAGED!!! How I am to give item as christmas present now?!?

Please I been sending you numerous ebay msgs since I paid for item (mainly on shipping) you never replied, however if you don't reply WITHIN 24 HRS now I AM GOING TO LODGE COMPLAINT WITH EBAY, WITH PAYPAL AND LEAVE YOU NEGATIVE FEEDBACK.
I must say I'm pretty disappointed, had I known item was not new but DAMAGED I WOULDN'T HAVE PURCHASED this it at all!

If ebay won't do anything about it, you can start a dispute through PayPal. "Item significantly not as described" is one of the boxes you can check.

Hopefully the seller responds and gets it fixed before it comes to that.

If I get no reply within 24 hrs that's what I'd do.

Thing is, even if I get a full refund, I'll have to see how to mend this appropriately or buy another pink set from somewhere... :(

I just took a photo of what I received:

I'll try first to cut the insulation plastic and then wind up the wires appropriately together, and cover everything up with white electrical tape.

If I make a mess...... I'll post on TPU.... :D

Doesn't keyboards often use standard USB connectors inside the keyboard? if so, you can take the wire from another keyboard and use that one.

So the cord was cleaved in twain? I must have speed read over that... XD

There wasn't anything in the box that could have cut it, was there? Even if there was, it was the seller's responsibility to make sure it is properly packaged.

Sounds interesting. Can you elaborate please?
You mean there'd be another USB connector inside the keyboard?
This is a Woolworths keyboard. There are 8 or 10 screws at the bottom. I'll take it apart tomorrow....

Nope the package was perfect and intact.
The cable's cut is very clean and sharp. It's not like someone pulled it, it's like it was cut with a very sharp knife.

There probably isn't a usb connector inside the keyboard. It's likely soldered.

Get his return address and post mark a dump in a box.

Well, seller ignored my messages.
I reported him to ebay, and opened a paypal dispute.
If he continues to ignore, I'll escalate the paypal dispute to a claim.

Get his return address and post mark a dump in a box.

Lol.

Any suggestions on what I could write as negative feedback guys?
:D

Well, reporting him to ebay and paypal kinda worked...

i am sorry about this i had no idea as you can see i have not recieved negative feedback before i had no idea the item was damaged as it was my daugters and she packaged it i have tried to refund your postage but it will not let me for some reason. i have not been on ebay for a few days as my daughter has been in hospital with bronchitis. i will however refund you if you are not happy even if i have to send it to you please email me to let me know how i can assist you further.

Ah, so he didn't know it was damaged. That explains a lot.

You believe he didn't know what was inside the package, that he let his daughter pack it and he didn't see what was inside, and he blindly listed it for sale on ebay, risking his precious 100% feedback?

In his email I quoted, he himself must have put his foot in his mouth for he said "it was my daughter's"...
Yet he listed item as new.

It's plausible. You have to be 18 or older to have an ebay account. She packaged it and had her father listed it. If she didn't tell him the cord was cut, it is very possible he wouldn't have known.

If it doesn't have the original retail box, it isn't new. That clearly is a listing error.

I don't agree with you there.

Firstly: I would never agree to list on ebay something which my dad (let alone daughter or anybody else for that matter) packaged without me knowing what was inside.

Secondly: On ebay there's BNIB (brand new in box), BNWB (brand new without box). I take it that if someone puts up on sale something which is new without box it means that item was bought for personal use, found unsuitable, not used but box had been thrown away. Like I buy an i7 processor, throw the box and stuff away, then find out it doesn't fit in my old P5B mobo. So I sell it without box, but totally unused.
Same as brand new with tags (BNWT) and brand new without tags (BNWOT) being in the first place something new sold by a shop and in the second instance something one might buy, remove tags, try it on and find that it doesn't fit. It would still be 'new' ie unused though without tags.

So yup new means new as 'unused' whether with tags, in box or whatnot.
Anything else, like in my case the keyboard is dirty, the speakers got scratches, and the keyboard cable is cut in half.... that can't be said to be "new without box" but "used and damaged and without box"...

The condition should have been "Used" and the description should have said "keyboard cable damaged." Both of those qualify as "item significantly not as described." "Without box" was already included in the description.

What happened behind the scenes is irrelevant. What is important is that you got scammed.

one time I purchased from one seller on ebay who was there for a long time and made a lot of sales, mostly positive (~98%) . So, I decided to buy from him but ... i got scammed... like several other buyers who later left their negative feedback

Now I don't know what I'm going to do now.

I had opened a claim with Paypal, and the seller never replied.

In the meantime I repaired the keyboard cable, and gave the whole pink set to my daughter as a xmas present. I installed everything while she was asleep at night, so she gets a surprise on xmas morning and also so that the mended part of the cable is deeply hidden in the cable management behind her desk.

Now that the seller's paypal deadline to reply is up, I received from Paypal informing me that the seller didn't reply and that for me to get a refund I have to ship everything back with a tracking number! Which is out of the question now...

I've searched on the Paypal site to check if there is an option where I can write that I'm ready to keep item and will agree if he refunds the 8 sterling the seller himself admitted having overcharged me for shipping, and perhaps something else for the trouble I took in mending the cable...
But I can't find the option to write anything.

What do you suggest I can do?
I don't think I can cancel the claim and open another one on the same item can I?

did the item go through customs?

I wouldn't put it past them to open it with box cutters, a no no with wired devices (or anythign with wires really).

we had that happen several times when I was working for whyle technical sales.

not to support the seller as obviously the shippign was shady, but just to mention it could have been intact when shipped, then spliced accidentally in customs.

No it didn't. It arrived on my doorstep, unsigned, just a puffy brown package with bubble wrap inside. Package and bubble wrap was all intact. When I opened the packaging, intact with bubble wrap and all I found the torn keyboard cable and the speakers also showed being used because there are those fingernail marks which some curious kid would poke on them.
