View Full Version : Maltese guy guilty of hacking email accounts to download movies - weird judgement?

A 25-year-old film buff was yesterday facing up to four years in jail but got off with probation after he admitted to hacking into people's internet accounts to download films.

Jonathan Cutajar would find a list of all the users' e-mail accounts on the Go website (his internet service provider) and then guess the password and username for each of the accounts.

Police Inspector Ivan Cilia said that this turned out to be pretty easy as people would use bits of their names as passwords and usernames.

He said he was alerted to the problem after customer complaints to the service provider prompted them to ask the police to investigate.

Defence lawyer Franco Debono asked the court to consider handing down a conditional discharge as his client has a clean police record.

But Magistrate Jacqueline Padovani said that this was out of the question and pointed out that he was facing up to four years in jail for what is effectively "stealing" other people's online accounts.

Agreeing to a proposal by the prosecution, Magistrate Padovani placed him under probation for 18 months and gave him a stern warning saying that he was playing with fire.

She told him that "just because you didn't break a window or a house door to steal a piece of gold does not mean what you were not stealing".

The magistrate then held up his police record and added: "What you did was very stupid and because of this your record is now tarnished".

I'm curious on several points here...

1) Is guessing email usernames and passwords actually "phishing"?

2) Why did he need to break into email accounts to download movies? Obviously one needn't go to the hassle of hacking others' email usernames and passwords just to download movies....

3) He was found guilty of "stealing" email accounts.... but no mention is made of him stealing movies?!? (I wonder if downloading movies is legal in my country? I don't think so since we're in the EU... gotta check that out...)

4) Do you think the punishment was adequate? 18 months probation is mainly that he's free (though with tarnished police record) unless he commits another crime within those 18 months.

2) they had bad interrogation tactics and that's all they could get him to admit to or had proof of.

in all likelyhood he was after bank statements and other information

3) probabally illegal but they may not have enough proof to prosecute on the movies.

4) dunno about EU but in America you have a probation officer and aren't allower to smoke or drink. you're also not allowed to go anywhere outside you're city of probation save for rare cases and you have to proove that youre becomign acontributin emmber of society.

might be a slap on the wrist but still pain in butt.
