A shit ton. I have a friend thats doing 25 for creating, running, and maintaining a meth lab in my home town. It exploded and the cops found out. When he got outa the hospital he was tried and sent to prison. Im sure making coke will get you more jail time but you could hide it alot easier than an exploding meth lab. Specially if you live around some forests.

I don't know about now, but in the late 80's and early 90's in NJ, there was a tremendous amount of difference even from one county to the next. If you got busted for possession with intent to distribute in one county for example, as a first time offender, there was a good chance you would get off with probation (depending on the quantity). The same bust in the next county over could get you several years of jail time. It was crazy.
But manufacture and sale of a narcotic was pretty much guaranteed jail time no matter where you were. But 25 years? IDK. |

Meth carries a much stiffer penalty than cocaine. 25 to life is standard for operating a meth lab now, which is a federal law, so locality has no effect on it.

Damned mandatory minimums huh? Maybe they're justified in a lot of cases - maybe even most - but definitely not all. Just my opinion though.

I mistook the title as "Cocoa Farmer" and was like why would anyone get jail time for harvesting cocoa.
Then I realized it was "Coca"...And then I felt stupid and had to post.

Seriously, if you have two parts of a meth lab together(well the cold pills and another thing otherwise it's 3 times together). Then more or less your guilty of what you could do with it.
It's crazy, but there is a ton of people in jail for it. From what I head it's starting to be the number one reason to be locked up in my state. Walmart has been calling the police on people buying the combo. Then they pull them over, and or follow them home and arrest them for it.

What's really funny to me is the fact that you can go to jail for decades for trying to cook meth, but you can get a script for dexadrine or ritalin probably with less effort than what it would take to get a course of antibiotics.
Then, to really top it off, they decided to make it a requirement for any schedule II narcotic (like an amphetamine) that you had to see your doctor every month for a new prescription - no refills. But that only made doctors want to prescribe it more because it meant guaranteed income for them. Normally a patient might have to go in 4 times a year, but every patient on an ADD or ADHD med had to come in 12 times a year. Ka-ching. |

That sounds right. An essential element of a conspiracy charge is that you have to perform an "overt act in furtherance of the conspiracy." So if they have wiretaps of you planning to cook meth or something like that, any action you perform to facilitate the conspiracy would be the last element of the crime that they need to prove. So even though the act itself is outwardly innocent, it ties you to the conspiracy.

I'd have a hard time believing that someone would go to jail for simply buying two pieces of paraphernalia. Carrying paraphernalia in a car is indeed a crime in most places (afaik) so I guess they could get you for that but it carries nowhere near a 15 year prison sentence. Most of the time if you buy such things they put you on an FBI watch list. My father is on such lists because, being an owner-operator trucker he has bought large quantities of ether for different purposes (starter fluid, inflating tires, etc.) I also have family members who have been in the meth business, so they probably watch him even closer, however he's never been arrested for it. Id be hard pressed to believe that someone would get a prison sentence for just buying batteries and OTC medicine. Perhaps if they had a drug record.

It's like carrying a baseball bat in your car with no ball or glove can be construed as having a weapon, and if it's hidden from view it could be considered concealed.
Meth is a poison and people caught manufacturing it should be sent to prison for a long time. 25 years may be excessive, but 10 would be appropriate. The laws controlling the sale of pills containing ephedrine have curbed the ease of access to the ingredients for the drug and enterprising methheads are distilling piss to recycle the drug now. Legalizing some drugs and taxing them is a decent idea, but meth should not be legal in any way, shape or form. |
